This type of visa is applied for investors and foreign lawyers working in Vietnam. Cap valid: 5 years.

2. WORK PERMIT (WP) IN VIETNAM

Temporary resident card is granted for:

3. TEMPORARY RESIDENT CARD (TRC)

Temporary resident card (TRC) is multiple visa and has the continuous valid from 2 to 5 years. In the valid term, foreigners who have TRC will easily to entry into /exit from Vietnam multiply as needed, save much more time and cost than time to time or single visas. 

The validity of the temporary resident card:

  • A foreigner who is a member of the two members limited liability company or more.
  • A foreigner who is the owner of the one-member limited liability company.
  • A foreigner who is a member of the board director of the stock corporation.
  • A foreigner who granted a working permit in all kinds of businesses or representatives offices of foreign companies.
  • Professionals, students, trainees who are in the national working or studying programs.
  • Relatives of the temporary resident cardholder include parents, spouse, and children.
  • The duration of TRC is at least 01 month shorter than the duration of the passport.
  • Temporary resident cards with the code NG3, LV1, LV2, ĐT, and DH have a term of no more than 05 years.
  • Temporary resident cards with the code NN1, NN2, TT have not more than 03 years.
  • Temporary resident cards with the code LD and PV1 have a term of no more than 02 years.
  • Expired temporary resident cards will be considered for issuance of a new card. 

4. PERMANENT RESIDENT CARD (PRC)

  • Permanent Resident Card is document issued by the immigration management agency to a foreigner who is permitted reside indefinitely in Vietnam and has the same validity as visa.
  • The conditions and application documents for granting PRC are often complicated. It only applied for foreign scientists, foreign experts or guaranteed by their parents, spouses or children who are Vietnamese citizens permanently residing in Vietnam… and they must have legal accommodation and stable income to ensure the standard of living in Vietnam.

5. OTHER COMPLIANCE PROCEDURES

Personal incomes tax is very complex and important requirements for an expatriate in Vietnam. You may optimize the tax payable amount and avoid lots of risky things if this matter is managed properly first time.

  • Personal income tax obligation and declaration

6. FOREIGN CHIEF OF REPRESENTATIVE OFFICE

Role and Responsibility of the chief:

The chief of representative office shall not concurrently hold the following titles:

  • Responsible within the power of attorney.
  • Responsible for activities out of the scope of authorization.
  • In the absence from Vietnam.
  • In case the chief is absent from Vietnam for a period of longer than 30 days without any authorization.
  • Authorized to sign, adjust or supplement contracts.
  • Employee profile and exclusive rights and obligations of a chief of representative office related to labor relations - tax - compulsory insurances in Vietnam.
  • The head of a branch of the same parent company.  
  • The head of a branch of another parent company.
  • The legal representative of the same Parent company or others.
  • The legal representative of a business organization incorporated in accordance with the Laws of Vietnam.

7. FOREIGN LEGAL REPRESENTATIVES

Legal representative of an enterprise is the individual that exercises the rights and fulfills the obligations on when making transactions on behalf of the enterprise, represents the enterprise as the plaintiff, defendant, and person with relevant interests and duties before the arbitral tribunal, the court, exercises other rights and fulfills other obligations as prescribed by law.

Responsibilities of the enterprise’s legal representative:

  • Performing the given rights and obligations in a truthful, careful manner to ensure the enterprise’s lawful interests.
  • Acting in the best interest of the enterprise; do not use information, secrets, business opportunities of the enterprise; do not misuse the position, power, or property of the enterprise for self-seeking purposes or serving the interest of other entities.
  • Employee profile and exclusive rights and obligations of a chief of representative office related to labor relations - tax - compulsory insurances in Vietnam.
